The relationship between the politics and the Ijtahad according to Mohammad Ghazalee and Imam Khomeini

The writer of this thesis has made an effort to examine the relationship between the politics and the Ijtihad according to Imam Mohammad Ghazalee and Imam Khomeini. The politics and the Ijtihad are both related to the area of action and that is related to the changing and the small matters. Therefor the politics and the Ijtihad are two concepts that are changing and they may be explained through unstable enjoyments and the connection of the two are also explained based on that instability. The re-making of the connection are two matters that are unstable and they are necessarily temporary and the being temporary of the matters and the events once they are influenced by the time and the place then they create the roles. Of course the range of the relationship between the Ijtihad and the politics is not just within the area of the details of the action and that is with respect to the politics and in fact that has to do with the generality of the political decrees and based on that the division of the practical wisdom and that is located within the two general and the detailed areas and they are accepted by the wise ones and those who are the Islamic jurisprudents. Based on that explanation of the politics and the Ijtihad the chapters of this research have taken a shape; the first chapter of this research is devoted to the generalities and the concepts of that.


The second chapter examines the influence of the bases of the epistemology of those two thinkers. Related to that I examine the arguments such as the interaction between the religion and the politics and that is one of the common arguments in their thought. Relating to the interaction between the religion and the politics two theories will be explained and they are the bases of the independence of the logic and the religious law concerning the bases and the politics of the government's policies and they are of a religious law kind.


In the third chapter the effect of the bases of the epistemology of the two thinkers on the politics and the Ijtihad will be examined. In that chapter emphasizing on the methodology of the jurisprudence principles of the Arabic linguistics I examine the common principles and they are in their thought such as the public good and the role that the time and the place play.  In the final chapter I discuss the arguments such as the essence of the political jurisprudence, the essence of the political action and the jurisprudential essence of the politics.
